Two men appeared in court on Monday, December 4th to answer a number of firearms and impaired driving charges.

"Shane Stainer pled guilty to count one and count eight on the information with respect to all the charges he was facing," explained Deputy Police Chief, Murray Cowan. "That being unlawfully transporting a prohibited firearm in a careless manner as well as impaired operation of a motor vehicle. He has since been released on a recognizance on a number of conditions and there will be a sentencing hearing for him on January 29, 2018."

"Kris Donald was remanded into custody for a show cause hearing which will be held this Monday."

Saturday evening was a busy one for the Estevan Police Service. Not only did they attend to 911 calls, noise complaints and a motor vehicle collision, they also made two arrests with quite a few firearm related charges.

Early in the evening, members were clearing from another incident when they noted a vehicle on the west end of the city operating without it's headlights on. The taillights weren't operational either. In addition, they noted that the vehicle was weaving all over the road. A subsequent traffic stop resulted, which led to a number of charges, including impaired driving and driving over .08," shared Deputy Police Chief Murray Cowen, adding that traffic offences also applied, as the vehicle was also unregistered.

"As the investigation unraveled in respect to the impaired driving, a search of the vehicle subsequent to the arrest resulted in the discovery of a firearm that had been stolen out of White Butte, Saskatchewan. It had been altered in such a way to make it a prohibited weapon, which of course led to additional charges."

The driver, Shane Stainer from Binscarth, Manitoba, is facing 9 Criminal Code Charges including...

  1. Transporting a prohibited firearm in a careless manner contrary to Sect 86(1) of the Criminal Code

  2. possess a prohibited weapon for a purpose dangerous to the public peace contrary to Sect 88 of the Criminal Code

  3. not being authorized under the Firearms Act to carry a concealed weapon did carry it concealed contrary to sect 90 of the Criminal Code

  4. was an occupant in a vehicle in which he knew that there was at that time a prohibited firearm contrary to Sect 94 of the Criminal Code

  5. did have in his possession a prohibited firearm knowing that it was obtained by commission in Canada of an offence contrary to Sect 96 of the Criminal Code

  6. possession of a firearm knowing that the serial number on it had been defaced contrary to Sect 108(1)(b) of the Criminal Code

  7. did possess a firearm without being the holder of a licence under which he may possess it contrary to Sect 91(1) of the Criminal Code

  8. while his ability to operate a motor vehicle was impaired by alcohol did operate a motor vehicle contrary to Sect255(1) and 253(1)(a) of the Criminal Code

  9. without reasonable excuse fail to comply with a breath test demand contrary to Sect 254(5) of the Criminal Code

  10. He is also charged with an offence under the Alcohol and Gaming Regulations Act – have keep consume alcohol in a vehicle and under the Traffic Safety Act - operate an unregistered vehicle.

The passenger, Kristofer Donald from Estevan, is also facing 9 Criminal Code Charges including...

1) Possession of a prohibited firearm knowing that he was not the holder of a licence under which he may possess it contrary to Sect 92(1) of the CC

2) Possession a firearm while he was prohibited from doing so by reason of an order contrary to Sect 117.01(1) of the CC

3) Transporting a prohibited firearm in a careless manner contrary to Sect 86(1) of the CC

4) Possession of a prohibited weapon for a purpose dangerous to the public peace contrary to Sect 88 of the CC

5) Not being authorized under the Firearms Act to carry a concealed weapon did carry it concealed contrary to sect 90 of the CC

6) Was an occupant in a vehicle in which he knew that there was at that time a prohibited firearm contrary to Sect 94 of the CC

7) Did have in his possession a prohibited firearm knowing that it was obtained by commission in Canada of an offence contrary to Sect 96 of the CC

8) Possession of a firearm knowing that the serial number on it had been defaced contrary to Sect 108(1)(b) of the CC

9) Breach the conditions of a probation order to wit: keep the peace and be of good behavior contrary to Sect 733.1(1) of the Criminal Code

This male was also charged with an offence under the Alcohol and Gaming Regulations Act – have keep or consume alcohol in a vehicle.  

The pair were arrested without incident and appeared in Estevan Provincial Court on Monday. The high calibre, bolt action rifle was seized and it's jurisdiction notified.
